Why digital records need early attention
A commercial dispute may turn on an email, a criminal case on CCTV footage, and a family dispute on a chat export. In each situation, collecting a visible screenshot is only the beginning. Counsel must understand where the record came from and how it will be proved.
The Bharatiya Sakshya Adhiniyam, 2023 addresses electronic records, including admissibility under Section 63 and a certificate format in its Schedule. Begin with the actual statute and applicable judicial interpretation. The steps below are a preparation checklist, not a promise that a particular file will be admitted.
Identify the governing evidence regime
Check the procedural history before replacing every reference to the Indian Evidence Act with a BSA section number. Section 170 contains repeal and savings provisions relevant to proceedings pending immediately before commencement. Record the dates and nature of the proceeding before deciding which framework to use.
A section-number comparison is a useful starting point, but it does not establish that earlier case law applies unchanged. Read the current language, the type of record relied on and later decisions addressing that question. Note any unresolved interpretation in the research memorandum.
Create a collection and custody record
Identify the device, account or system holding the information. Record the collector, collection time, export method and any relevant settings such as time zone. Keep the collected version intact and use a separate copy for annotations or redactions.
Consider an email dispute: preserve the available native message and headers, not just text pasted into a document. For a video, record how the file was retrieved and whether it was converted. These details help explain the record and allow a specialist to assess integrity if authenticity is challenged.
Read Section 63 and the Schedule together
Where the Section 63 route is relied on, examine the statutory conditions and the certificate requirements in subsection (4). The Schedule provides a format with party and expert parts. Review the prescribed particulars and signatures against the way the electronic output was produced.
A certificate is not a substitute for a truthful account of the underlying process. Identify who knows how the relevant system operated and what they can actually certify. Obtain appropriate technical assistance where required rather than asking a witness to adopt statements outside their knowledge.
Separate admissibility from what the record proves
Even after an electronic record crosses an admissibility threshold, disputes may remain about authorship, completeness, context or reliability. A message from an account does not by itself settle every question about who controlled it at the relevant time.
Prepare for alternative explanations. Is the conversation complete? Is there a gap in a recording? Could an apparent timestamp reflect a different time zone? A useful evidence note identifies the proposition supported by each item and the limitations the opposing party may raise.
Build an evidence index that a senior can use
For each item, record its identifier, description, source, custodian, date range, relevant issue, proposed mode of proof and outstanding certificate or witness requirement. Connect it to the paragraph of the pleading that relies on it.
Before the hearing, verify that the filed version matches the reviewed version and that counsel can locate the supporting material quickly. Keep disputed legal questions separate from missing practical steps, so the team can resolve both without confusing one for the other.
